Chapter 8 - The Custody Trap

Thomas Vale had supposedly drowned two months before the photograph was taken.
That fact changed the investigation overnight.
Ortiz confirmed the date printed on the back of the photograph.
It matched Michael Sullivan's hospitalization.
Security records from the hospital still existed in archived form.
Richard Vale had visited.
Evelyn Bennett had visited.
A man using the name Thomas Vane had also signed in.
The spelling difference had apparently gone unnoticed.
Claire stared at the visitor log.
"Thomas was alive."
Ortiz said, "If that was Thomas."
"Grant recognized him."
"Grant recognized the man in a photograph."
"He grew up with him."
"I understand. But we verify."
They did.
An old hospital hallway camera had captured the visitor.
The image quality was poor.
But Grant identified Thomas immediately.
So did two former employees from Vale & Bennett.
The dead man had walked into the hospital alive.
Six years ago.
The question became unavoidable.
Whose body had been recovered from Lake George?
Claire had never imagined her daughter's haircut would lead to an exhumation request in upstate New York.
Yet forty-eight hours later, prosecutors were seeking exactly that.
Vanessa remained in custody.
Richard Vale remained her attorney.
Evelyn had stopped cooperating.
And Grant finally admitted a detail he had concealed.
"Thomas and Vanessa knew each other."
Claire stared at him across Maya's conference room.
"You told police you had never seen Vanessa before you started dating her."
"I hadn't."
"Then how do you know they knew each other?"
"Because Thomas told me about a woman named Vanessa."
Claire's jaw tightened.
"When?"
"Years ago."
"You forgot?"
"I didn't know it was the same Vanessa."
"How many Vanessas did Thomas date?"
"I don't know."
"Grant."
"One that I remember."
Claire leaned back.
"And you didn't think this mattered after finding out Chloe is Thomas's daughter?"
"I told Ortiz this morning."
"You told him after the DNA test forced you to."
Grant looked down.
Claire continued.
"What did Thomas say about her?"
"That she was ambitious."
"Meaning?"
"She wanted money."
"According to Thomas?"
"Yes."
"Thomas, the man who apparently faked his death?"
Grant looked irritated.
"I understand how it sounds."
"Do you?"
Maya interrupted.
"Stay focused. Did Thomas ever mention Chloe?"
"No. He supposedly died before she was born."
Claire looked at Grant.
"Or disappeared."
Grant nodded slowly.
"Maybe."
That afternoon, a family court judge reviewed the emergency petition.
Vanessa's attorney attempted to introduce footage of Claire slapping Vanessa and cutting her hair.
Maya had expected it.
The hidden camera footage was shown.
Claire hated watching herself.
Her face twisted with rage.
Her hand striking Vanessa.
The scissors closing around Vanessa's hair.
She looked like someone Claire barely recognized.
Richard Vale described it as proof of violent instability.
Then Maya played the preceding recording.
Lily crying.
Vanessa cutting her hair.
The blood.
The coercion.
The judge watched without expression.
Then Maya presented recovered messages showing the confrontation had been designed specifically to trigger Claire.
Richard objected.
The judge overruled him.
Grant testified.
"I was wrong about Claire."
Richard approached.
"Mr. Bennett, didn't you previously express concern regarding your former wife's emotional stability?"
"Yes."
"Didn't you speak with me about seeking primary custody?"
"Yes."
Claire forced herself not to react.
Richard continued.
"And wasn't that before the haircut incident?"
"Yes."
"So Vanessa did not invent your concerns."
Grant looked toward Claire.
"No. She manufactured the evidence that created them."
Richard's jaw tightened.
Grant continued before Richard could interrupt.
"I saw edited videos. I believed they showed Lily behaving violently. I now know the full recordings show Vanessa provoking those incidents."
"And you blame your wife for your own judgment?"
"I blame myself for my own judgment."
Claire looked at him.
It was the first answer he had given that did not contain an excuse.
The judge extended Claire's temporary custody order.
Grant received supervised visitation.
Vanessa received no contact.
The immediate custody trap had failed.
Claire should have felt victorious.
Instead she watched Chloe sitting outside the courtroom with a social worker.
The child looked lost.
Her mother was in jail.
The man she called Dad was not her biological father.
Her biological father might be alive.
Claire walked over.
Chloe looked up.
"Is Lily here?"
"No."
"Does she hate me?"
Claire crouched.
"No."
Chloe's eyes filled.
"Mommy said she would."
"Your mommy said a lot of things that weren't true."
"Can I give Lily something?"
Chloe opened her hand.
Inside was a tiny yellow hair clip.
Claire recognized it.
Lily had once given Chloe a matching pair.
"I found it under my bed."
Claire took it.
"I'll give it to her."
Chloe nodded.
Then whispered, "I know where Mommy kept the other phone."
Claire froze.
"Another phone?"
Chloe nodded.
Claire looked toward the social worker.
"Can she tell Detective Ortiz?"
The social worker gently asked Chloe if she wanted to.
Chloe nodded.
An hour later, police returned to Grant's house.
Chloe led them upstairs.
Not to Vanessa's office.
To her own bedroom.
She pointed at a stuffed white rabbit.
Ortiz opened a seam along the back.
Inside was a small phone.
Not Vanessa's second phone.
A third.
The device contained no calls.
No photographs.
Only a secure messaging application.
Most conversations were encrypted beyond immediate recovery.
One, however, remained open.
The contact had no name.
Only the letter T.
The last message had been sent the night before Vanessa was arrested.
T: If Claire finds the archive, don't call Evelyn.
Vanessa: Why?
T: Because Evelyn is expendable.
Vanessa: What about me?
T: So are you.
Vanessa had replied three times.
Who is this?
Thomas?
Answer me.
The messages were unread.
Claire stared at the screen.

And he seemed willing to sacrifice everyone involved.
