Chapter 13 - The Worst Decision

The legal system moved slower than fear.

Vanessa was arrested in connection with Noah's disappearance, but her attorney challenged the circumstances.

Beatrice claimed Vanessa had not kidnapped Noah.

According to her, Daniel had agreed months earlier that Beatrice could temporarily care for the baby.

There were text messages.

Old ones.

General ones.

Daniel had once written, You can take Noah anytime Vanessa needs a break.

Vanessa's lawyer turned that sentence into permission.

The criminal case remained active, but bail was granted.

A temporary protective order kept Vanessa away from Ethan.

Noah's custody case continued separately.

Then came the house.

Daniel wanted Vanessa out permanently.

Her attorney argued the marital home was jointly occupied and that Daniel had no unilateral right to exclude her before property issues were decided.

Rachel fought it.

The judge allowed Vanessa one supervised visit to retrieve belongings.

That visit changed everything.

Vanessa entered with her attorney and a professional supervisor.

Daniel stayed downstairs.

Ethan was supposed to remain at Laura's apartment.

Noah was with Laura.

For ninety minutes Vanessa packed clothes.

Jewelry.

Documents.

Personal items.

Then she asked to enter the nursery.

The supervisor allowed it.

Vanessa stood there for a long time.

She touched the crib.

The changing table.

The empty camera bracket.

She cried.

The supervisor later described it as grief.

But when nobody was looking, Vanessa slipped a small object beneath the crib mattress.

Two days later, Daniel moved back into the house with Noah.

Ethan refused at first.

"I don't want to live there."

Daniel nodded.

"Then we don't."

Ethan looked surprised.

Daniel continued.

"We can sell it."

"You love that house."

"I love you more."

The words came easily now.

Months earlier they might have solved everything.

Ethan looked at Noah.

"Can we stay until the hearing?"

"If you want."

Laura agreed to remain nearby.

Rachel advised security cameras.

Daniel installed them everywhere except bathrooms and bedrooms.

He replaced the nursery camera.

He changed locks.

For a few days, life became almost peaceful.

Then Ethan found the object beneath the crib mattress.

A small digital recorder.

He brought it to Daniel.

"What is this?"

Daniel recognized it instantly.

He had seen similar devices in Martin's attic case.

Rachel had it examined.

The recorder contained hours of audio.

Most of it useless.

Then technicians recovered older files.

Vanessa talking to Martin.

Martin advising her to document Daniel's temper.

Vanessa complaining Ethan was becoming a problem.

Beatrice asking what happened if Daniel refused to amend the estate.

Martin saying, "Then we create leverage."

The strongest recording came from before Noah's birth.

Vanessa's voice was clear.

"Once Noah is here, Daniel won't risk losing another child."

Martin replied.

"And Ethan?"

Vanessa said, "He'll be gone eventually."

Daniel listened to the recording twice.

Then turned it off.

Ethan stood in the doorway.

"You heard?"

Daniel nodded.

"Yeah."

"She planned it."

"Yeah."

Ethan leaned against the frame.

"Do you still love her?"

The question surprised him.

Daniel thought carefully.

"I loved who I thought she was."

"That's not what I asked."

Daniel looked at his son.

"No."

Ethan nodded.

Then he asked the harder question.

"Do you hate yourself?"

Daniel stared.

Ethan continued.

"Because you didn't know?"

Daniel sat down.

"Sometimes."

"Does it help?"

"No."

"Then stop."

Daniel almost smiled.

"When did you get smarter than me?"

"Around age six."

Daniel laughed.

The sound felt strange.

Good.

For the first time, Ethan smiled too.

The custody hearing was scheduled for Thursday.

Wednesday afternoon Rachel called.

"Vanessa wants to negotiate."

Daniel laughed.

"No."

"Listen first."

"What does she want?"

"She'll surrender claims to temporary custody if you agree not to pursue certain financial fraud allegations until the criminal matter is resolved."

"No."

"I expected that."

"Why would she offer now?"

Rachel paused.

"Because the recorder is devastating."

Daniel looked toward the nursery.

Noah was sleeping.

Ethan was doing homework nearby.

"Then let it destroy her case."

Rachel agreed.

That night Daniel checked every lock twice.

At 6:30 the next morning he left for Rachel's office.

Laura was supposed to arrive at eight.

Ethan stayed home with Noah.

Daniel almost changed his mind.

"I can take you both."

"Dad."

"I don't like leaving you."

"I know."

"Laura will be here in ninety minutes."

"I know."

Daniel pointed to his phone.

"Call me."

"I know."

"No opening doors."

"I know."

"No."

Ethan smiled.

"No mysterious strangers, no accepting candy, no joining traveling circuses."

Daniel almost laughed.

Then he hugged him.

"Love you."

Ethan went still.

Daniel realized he had not said it enough.

"Love you too."

Those were the last calm words spoken in the house.

Forty-three minutes later, Ethan heard the back door alarm.

He ran downstairs.

Vanessa stood in the kitchen.

Daniel had changed the locks.

But Martin had known where the emergency key was hidden inside the detached garage.

And Vanessa had come for Noah.
