Chapter 9 - fifty seven seconds
The emergency custody hearing was scheduled for Friday.
Three days.
Rachel spent those three days doing something Marcus had never expected.
Nothing dramatic.
She did not post about him.
She did not call his coworkers.
She did not confront Elaine.
She did not send long messages defending herself to relatives.
She documented.
Nora told her to save everything.
Rachel created folders.
Hospital.
Police.
Marcus messages.
Elaine messages.
Family chat.
Incident log.
Thomas.
She downloaded copies to two devices.
Leah stored another copy.
Nora's office stored a third.
Meanwhile, Marcus sent messages that became increasingly careful.
I hope you and Eli are safe.
Please consider allowing me to see him.
I am concerned that outside influences are escalating this.
Rachel answered only through Nora when possible.
Elaine was less careful.
She sent Rachel nineteen messages in one day.
You know Marcus did not mean to hurt you.
He has worked too hard for you to do this.
Thomas is going to think Marcus is some kind of monster.
What happens when Marcus is fired?
Do you want your son growing up poor?
Rachel saved every one.
On Thursday afternoon, Nora called.
"I received a response from Collins Meridian's legal department."
Rachel's heart jumped.
"The recording?"
"They confirmed it exists and is preserved."
"Can we get it?"
"They will comply with a court order or subpoena. For tomorrow's emergency hearing, they provided a sworn declaration from Thomas describing what he personally heard."
Rachel sat down.
"What does it say?"
Nora read.
Mr. Collins abruptly left the video conference after an infant began crying. The conference remained connected. I heard Mr. Collins speaking loudly to his wife. I heard Mrs. Collins state words to the effect of "let go of my hair." I then heard a loud impact and a female cry. I subsequently heard another woman blame the infant for interfering with Mr. Collins's career.
Rachel closed her eyes.
Nora continued.
Mr. Collins later told me that his wife had experienced an emotional episode and injured herself. Based on what I personally heard, I believed that description was inconsistent with the events audible on the call.
Rachel whispered, "He really signed that?"
"Yes."
Marcus had built his identity around being admired by Thomas.
Thomas was twenty years older.
Calm.
Respected.
Marcus talked about him constantly.
Getting Thomas's approval mattered more to Marcus than he admitted.
Now Thomas's name was on a sworn statement contradicting him.
Nora said, "There's more."
Rachel waited.
"The company also preserved Marcus's messages sent immediately after the call."
"The ones I saw?"
"Those and additional ones."
Rachel sat straighter.
"What additional ones?"
Nora read.
Marcus: Sorry about the noise. My wife is not well.
Thomas: Marcus, I heard her tell you to let go of her hair.
Marcus: You misunderstood.
Thomas: I heard what I heard.
Marcus: She's emotional and exaggerates everything.
Thomas: I am ending this conversation until HR is involved.
Rachel felt a strange chill.
Marcus had known.
From the beginning, he had known Thomas heard.
And still he had come to Leah's house carrying flowers and telling a police officer Thomas only heard yelling.
"He knew the recording existed," Rachel said.
"Possibly."
"No. He complained about the compliance system all the time."
Nora nodded.
"Then tomorrow may be interesting."
Friday morning, Rachel entered family court carrying Eli.
Marcus was already there.
Elaine sat behind him.
When Elaine saw the baby, her face softened dramatically.
"My sweet boy."
Rachel moved closer to Leah.
Elaine's expression hardened.
Marcus approached.
Nora stepped between them.
"All communication through counsel."
Marcus looked at Rachel.
"I just want to see my son."
Rachel said nothing.
Inside the courtroom, Marcus's attorney presented the incident log.
He described Rachel as overwhelmed.
Exhausted.
Potentially unstable.
He emphasized her recent childbirth.
Then Nora stood.
"Has Mrs. Collins ever been diagnosed with postpartum psychosis?"
Marcus's attorney admitted she had not.
"Has any medical provider expressed concern that she is psychotic?"
No.
"Did the hospital that examined her two days ago document psychosis?"
No.
Nora handed the judge the hospital records.
Then the police report.
Then Thomas's declaration.
Marcus's attorney objected.
The judge read quietly.
Marcus stared at Rachel.
The judge looked up.
"Mr. Collins claims Mrs. Collins injured herself in a fall."
Nora nodded.
"Yes, Your Honor."
The judge continued.
"But a third-party witness states he heard Mrs. Collins say, 'Let go of my hair,' immediately before the impact."
Marcus whispered to his attorney.
The judge looked toward him.
"Mr. Collins, you will have an opportunity to testify at a later evidentiary hearing."
The emergency order came twenty minutes later.
Eli would remain with Rachel temporarily.
Marcus would have supervised contact pending further review.
Marcus looked stunned.
Elaine looked furious.
Outside the courtroom, she approached Rachel before Nora could stop her.
"You think you won?"
Rachel looked at her.
Elaine lowered her voice.
"You have no idea what Marcus is capable of when someone humiliates him."
Rachel stared at her.
It was meant as a threat.

But Elaine had accidentally given Rachel something else.
A warning.
