Chapter 13 - under oath
The full evidentiary hearing began on a Tuesday morning.
Rachel wore a dark blue dress.
Not because Nora told her to look professional.
Because she wanted one day in which Marcus had not chosen anything about her.
Her clothes.
Her expression.
Her words.
Eli stayed with Leah.
Rachel entered court alone beside Nora.
Marcus looked thinner.
His expensive suit hung slightly loose across his shoulders.
Elaine sat behind him.
Thomas Whitaker sat near the back.
Marcus noticed him.
The reaction was immediate.
His face tightened.
Thomas did not look away.
Marcus testified first.
His attorney guided him carefully.
Marcus admitted there had been an argument.
He admitted touching Rachel's hair.
But he described it as accidental.
"I reached toward her because she was moving quickly."
Nora later asked:
"Did you pull her hair?"
"No."
"Did she say, 'Let go of my hair'?"
"I don't remember."
"Did you hear her say it on the company recording?"
Marcus hesitated.
"I heard something like that."
"Was she lying while the incident was happening?"
"I believe she was highly emotional."
Nora nodded.
"So your testimony is that while you were physically near her, Mrs. Collins falsely announced that you were pulling her hair immediately before she fell?"
Marcus looked toward his attorney.
"I don't know what she believed was happening."
Nora let the answer sit.
Then asked:
"Did you tell Thomas Whitaker that Mrs. Collins injured herself during a postpartum episode?"
"I was trying to explain a chaotic situation."
"Yes or no?"
"Yes."
"Had any doctor diagnosed Mrs. Collins with postpartum psychosis?"
"No."
"Had any doctor suggested she had postpartum psychosis?"
"No."
"Then why did you use that phrase in your emergency custody petition?"
Marcus swallowed.
"I was concerned."
Nora displayed the nursery recording.
Marcus's own voice filled the courtroom.
If my boss heard any of that, you're going to tell him you had a postpartum episode.
Marcus looked down.
Nora stopped the video.
"Mr. Collins, were you concerned about postpartum psychosis at that moment?"
"Yes."
"Then why did you order your wife to tell your boss she had experienced an episode instead of asking whether she needed medical care?"
Marcus did not answer.
"Mr. Collins?"
"I used the wrong words."
Nora played the next line.
Elaine's voice:
If she refuses, we tell everyone she's unstable before she gets the chance to tell them anything.
Nora looked at Marcus.
"Did you object when your mother said that?"
"No."
"Did you correct her?"
"No."
"Did you seek medical treatment for Rachel?"
"No."
"Did you seek psychiatric treatment for Rachel?"
"No."
"Did you call her doctor?"
"No."
"Did you call emergency services?"
"No."
"Did you instead message your boss and family telling them she was unstable?"
Marcus said nothing.
Nora returned to her table.
Thomas testified next.
He spoke calmly.
He explained the conference.
The recording.
Marcus leaving his desk.
The sounds he heard.
Nora asked, "Why did you preserve the recording?"
Thomas replied, "Because Marcus gave me an explanation that conflicted with what I personally heard."
Marcus stared straight ahead.
Thomas continued.
"He told me his wife had injured herself during an emotional episode. I had heard her telling him to release her hair immediately before a loud impact."
Marcus's attorney asked whether Thomas saw the physical contact.
"No."
"Then you cannot know what happened."
Thomas considered the question.
"I know what I heard."
Elaine testified last.
She swore she carefully placed Eli on the bed.
Nora played the nursery clip.
Elaine's face turned red.
"That angle makes it look worse."
Nora asked, "Did you tell Rachel to keep her newborn silent during business hours?"
"I may have said something about Marcus working."
The company recording played.
If you can't keep a newborn silent during business hours, you shouldn't be responsible for him.
Elaine shifted.
Nora continued.
"Did you tell Marcus to claim Rachel was unstable before Rachel could speak?"
"No."
The nursery recording played.
If she refuses, we tell everyone she's unstable before she gets the chance to tell them anything.
Elaine looked toward Marcus.
Nora waited.
"Mrs. Collins?"
Elaine said, "I was upset."
"You denied saying it."
"I didn't remember."
"You remembered enough to submit a seven-page affidavit about the morning."
Elaine's attorney objected.
The judge overruled.
Nora placed Elaine's old email on the screen.
Never allow her to be the first person telling the story.
Elaine's face went pale.
Nora said, "That email was written eight months before the incident."
Elaine did not answer.
"You were already advising Marcus to create documentation portraying Rachel as unstable if she ever tried to leave, weren't you?"
"I was protecting my son."
Nora nodded.
"From what?"
Elaine opened her mouth.
Nothing came out.
The judge issued her decision two days later.
Rachel sat in Nora's office while the written order arrived.
Temporary sole physical custody to Rachel.
Marcus's visitation would remain supervised.
No direct contact outside a court-approved parenting application.
Marcus would complete a domestic violence intervention program and psychological assessment before requesting expanded parenting time.
Elaine would have no unsupervised contact with Eli.
Rachel read that sentence twice.
No unsupervised contact.
Nora continued.
The judge found Marcus's claims regarding Rachel's mental health lacked credible medical support.
She found significant evidence that Marcus attempted to construct a misleading narrative before and after the incident.
She specifically found Elaine's testimony not credible.
Rachel began crying.
Nora handed her a tissue.
"These are good tears?"
Rachel laughed through them.
"I don't know."
For six months Rachel had wanted a judge to say the word liar.
The order did not.
Courts used different language.
Not credible.
Unsupported.
Inconsistent.
