Chapter 10 - THE PETITION
Daniel filed the petition at 4:17 p.m.
Amelia received electronic notice before the hospital delivered Emma’s discharge paperwork.
The filing requested temporary emergency custody for Daniel and supervised visitation for Rachel.
It described Rachel as emotionally unstable, confrontational, and responsible for allowing Emma to wander into a hazardous area during the engagement party.
It included statements from three guests.
One claimed Rachel had been shouting.
One claimed Rachel had threatened to take Emma away.
One claimed Emma had been unattended for several minutes.
The filing did not mention the sedative.
It did not mention the disabled security cameras.
It did not mention Margaret’s recorded statement.
It portrayed the trash can as an accident.
Rachel read the first page and then stopped.
“I cannot read this.”
Amelia closed the file.
“You do not need to. I do.”
“Will a judge believe it?”
“Emergency petitions are designed to make judges act quickly. We respond with medical records, the police report, the 911 recording, and evidence of the private investigation.”
“Can Daniel take her tonight?”
“I am filing an immediate opposition.”
Rachel looked toward Emma.
Her daughter sat on the bed eating crackers and watching a cartoon.
She had no idea her father was asking a court to separate them.
“Why would he do this?”
Lily stood near the door.
“Because my mother told him you would do it first.”
“He could have spoken to me.”
“He stopped speaking to you months ago. He has only been managing you.”
Rachel thought of every argument that ended with Daniel asking her to calm down.
Every question he avoided.
Every promise to handle Margaret privately.
He had not been protecting Rachel from his family.
He had been protecting the family from Rachel.
Her phone rang.
Daniel.
Amelia shook her head.
“Do not answer.”
Rachel answered.
“Why?”
Daniel was silent for several seconds.
Then he said, “I am trying to protect Emma.”
“From me?”
“From chaos.”
“Your mother drugged her.”
“There is no proof.”
“Your investigator put her in a trash can.”
“He was not my investigator.”
“Your initials are on the invoices.”
“I authorized security assessments.”
“Emergency relocation planning?”
“I did not know what that phrase meant.”
“You paid North Vale.”
“That was for legal and security preparation.”
“To take Emma.”
“To make sure you could not disappear with her.”
Rachel closed her eyes.
“You planned this before the party.”
“I planned for the possibility that our marriage might end.”
“Why?”
“Because you sent emails to a divorce attorney.”
Rachel opened her eyes.
“How did you know?”
“The investigator accessed your cloud account.”
Even Amelia looked shocked.
“You hacked my email.”
“I monitored a shared device.”
“My phone is not shared.”
“The tablet at home was connected.”
Rachel felt exposed all over again.
Daniel continued.
“You were preparing to leave.”
“I sent the email after Lily told me you were investigating me.”
“You had drafted it three weeks earlier.”
“Because I was frightened of your mother.”
“And now Emma almost died because you were distracted by an argument.”
Rachel’s voice became quiet.
“Did you know Aaron would be at the party?”
Daniel hesitated.
That hesitation was enough.
“What was he supposed to do?”
“Observe.”
“Why was he dressed as a caterer?”
“I didn’t arrange that.”
“What was emergency relocation?”
“I told you, I did not understand the wording.”
“You are lying.”
“I am trying to prevent you from destroying our daughter’s life.”
“You nearly let your family destroy her body.”
Daniel’s voice cracked.
“I love her.”
“No. You love possessing her.”
“That is unfair.”
“No. It is exact.”
Rachel ended the call.
Amelia immediately began making legal calls.
Within an hour, a judge scheduled a remote emergency hearing.
Rachel sat in the hospital consultation room beside Amelia while Daniel appeared on a screen with two attorneys.
Margaret sat behind him.
The judge reviewed the medical report.
He listened to the 911 recording.
Margaret’s voice played through the speakers.
We only wanted her out of the family photograph.
Then Vanessa’s voice.
She told us to hide the little girl.
Daniel’s attorney argued that the statements were emotional and ambiguous.
Amelia introduced the investigator’s invoices and evidence of unauthorized surveillance.
The judge’s expression changed.
He denied Daniel’s request for sole temporary custody.
But he did not grant Rachel everything she wanted.
Until the investigation was complete, both parents would retain legal rights.
Emma would remain with Rachel.
Daniel would receive supervised visits.
Neither parent could remove Emma from the state.
Margaret and Charles were prohibited from contact.
Rachel felt relief.
Then the judge added one final order.
Because both parents accused the other side of manipulation, Emma would be evaluated by a court-appointed child specialist.
Daniel’s attorney requested Dr. Simon Vale.
Amelia objected.
The judge reviewed the name.
“Dr. Vale appears qualified.”
Lily, standing behind Rachel, whispered, “No.”
The judge approved the appointment.
The hearing ended.
Rachel turned to Lily.
“Who is Simon Vale?”

“He is the reason Aunt Vanessa was afraid to tell you what happened years ago.”
