Chapter 9 - The Hearing)

The emergency hearing was scheduled for the following Monday.
Daniel arrived wearing a navy suit.
He looked like the man Claire had married.
Calm.
Respectable.
Concerned.
Margaret sat behind him.
She wore gray.
No jewelry.
No makeup.
She looked like a worried grandmother instead of the woman who had forced psychiatric documents into Claire’s hands.
Claire understood the strategy.
They wanted normality.
So Claire brought evidence.
Rebecca testified first.
She described Daniel locking the office door.
Margaret placing the pen into Claire’s hand.
Daniel gripping Claire.
The blood on the signature.
Daniel’s attorney attacked her professionalism.
“Isn’t it true you arrived with a sealed document already biased against my client?”
Rebecca did not blink.
“I arrived with a sealed document I had not opened.”
“But you knew it concerned the Bennett family.”
“Yes.”
“So you were suspicious.”
“Yes.”
“Therefore biased.”
Rebecca leaned closer to the microphone.
“Suspicion is not bias when the behavior confirms it.”
Daniel’s attorney changed subjects.
Julia called Claire.
The courtroom went silent.
Claire moved carefully to the witness stand.
Her cast was visible.
So was her pregnancy.
Julia did not ask dramatic questions.
She asked simple ones.
“Did you voluntarily sign the psychiatric directive?”
“No.”
“Did Daniel hold you?”
“Yes.”
“Did Margaret force a pen into your hand?”
“Yes.”
“Why did you strike Margaret’s wrist?”
“To stop her.”
“Why did you kick Daniel?”
“Because he reached for me again.”
Daniel stared at Claire.
Not angry.
Betrayed.
As though she were violating a private rule by telling the truth publicly.
His attorney stood.
“Mrs. Bennett, did you secretly maintain a bank account?”
“Yes.”
“Did your husband know?”
“Not initially.”
“Did you hide money from him?”
“I kept money I earned before marriage in an account under my name.”
“Did you become angry when he discovered it?”
“Yes.”
“Did you fall down the stairs during an argument about that money?”
“Yes.”
“Did Daniel push you?”
Claire paused.
“No.”
Daniel relaxed slightly.
His attorney smiled.
“So the fall was accidental.”
Claire looked at Daniel.
“No.”
The attorney frowned.
“You just said he did not push you.”
“He grabbed me when I tried to walk away.”
“Did he intend for you to fall?”
“I cannot know his intention.”
“So you admit this may have been a tragic accident.”
Claire answered carefully.
“I admit that he grabbed a pregnant woman beside a staircase because she refused to obey him.”
The courtroom went quiet.
Daniel looked away.
Julia then introduced the hidden psychiatric file.
The attorney objected.
The judge allowed portions relevant to the emergency custody claim.
Then came the trust evidence.
That was when Daniel’s attorney requested a recess.
Margaret leaned toward him.
They whispered.
Eleanor entered the courtroom during the recess.
Margaret saw her first.
The color left her face.
Daniel turned.
For the first time since Claire had known him, Daniel looked like a child.
“Aunt Eleanor?”
Eleanor stopped ten feet away.
“You should have told the truth seven years ago.”
Daniel stood.
“I thought you were dead.”
“No.”
“You let me think you were dead?”
“You helped your mother arrange the circumstances that nearly killed me.”
Daniel looked around.
People were watching.
His voice dropped.
“I didn’t know what she planned.”
“You knew enough.”
Margaret stood.
“This is ridiculous.”
Eleanor turned toward her.
“No, Margaret. Ridiculous was spending eight years believing fear would keep everyone silent.”
Daniel’s lawyer approached.
“Do not discuss this here.”
Margaret ignored him.
She pointed at Eleanor.
“You abandoned this family.”
Eleanor said, “I survived you.”
The hearing resumed.
Julia called Eleanor.
Then played the audio.
Daniel’s recorded voice filled the courtroom.
You said no one would get hurt.
Margaret’s answer followed.
She survived.
Daniel lowered his head.
Margaret remained still.
The judge listened to everything.
At the end of the hearing, she denied Daniel’s emergency custody request.
She extended Claire’s protective order.
She ordered that any custody proceedings after birth be supervised by a guardian ad litem and that Daniel have no unsupervised contact with Claire.
Then she addressed Daniel directly.
“Mr. Bennett, this court is deeply concerned by the pattern presented here.”
Daniel said nothing.
Claire should have felt victorious.
Instead, she noticed Margaret.
Margaret was smiling.
Small.
Private.
Claire knew that smile.
It meant Margaret believed she still held something.
Outside the courtroom, Eleanor confirmed it.
“There’s one document missing from Locker 214.”
“What document?”
“The original family trust certificate.”
“What happens if Margaret has it?”
“She may be able to move assets before the freeze is complete.”
Claire frowned.
“Why does that matter now?”
Eleanor looked at her.
“Because some of those assets are legally designated for Daniel’s first child.”
Claire touched her belly.
“How much?”
Eleanor answered.
“Almost twelve million dollars.”
Claire stared.
May you like
Eleanor continued.
“And if Margaret gets control before your daughter is born, she can make that money disappear.”
