Chapter 11 - under oath)

Diane looked fragile on the witness stand.
Kallie knew better.
Her mother had always known how to appear softer than the damage she caused.
Seth's attorney asked the questions first.
"Mrs. Reed, did you see your son intentionally strike Paisley Reed?"
Diane folded her hands.
"No."
"Describe what you saw."
"Paisley was pulling on a ribbon. Seth reached over to remove her hand. There was contact. Then Kallie became very upset."
Kallie stared straight ahead.
Very upset.
Again.
"Did Seth appear angry?"
"Not before Kallie started shouting."
"Did he say he intended to hurt Paisley?"
"No."
"Did you observe any serious injury?"
"No."
The attorney nodded.
"No further questions."
Elena stood.
"Mrs. Reed, how many grandchildren do you have?"
Diane blinked.
"Three."
"You love them?"
"Of course."
"Including Paisley?"
"Yes."
"Then why did you not check Paisley's face after the contact?"
Diane hesitated.
"I believed she was fine."
"Did she cry?"
"Yes."
"Loudly?"
"She was upset."
"Did her cheek become red?"
A pause.
"Somewhat."
Elena lifted a transcript.
"Did you tell Seth, twenty-three minutes later, quote, 'You hit her too hard. Her cheek was bright red'?"
Seth's attorney stood.
"Objection."
The judge looked at Elena.
"Foundation?"
"We will establish through authenticated audio evidence."
The judge nodded.
"Overruled for now. Witness may answer if she remembers."
Diane's face changed.
"I don't recall."
Elena looked at her.
"You don't recall telling your son he hit Paisley too hard?"
"No."
"Did you tell investigators Seth's hand accidentally made contact?"
"That was my memory."
"Did you ever discuss with relatives what they should say?"
"No."
"Never?"
"No."
"Did your husband?"
"Not that I know of."
Kallie looked toward Richard.
He stared at Elena.
The confidence in the family began to look thin.
Later Richard testified.
He denied coaching witnesses.
Denied encouraging deletion of videos.
Denied knowing Seth intended to hit Paisley.
He admitted driving near Kallie's house but denied leaving the threatening photograph.
Then Seth testified during a related portion of the proceeding.
He described the contact as accidental.
He said Kallie had always disliked his parenting.
He said Erin was using the situation to damage his relationship with Hallie.
Elena asked:
"Did you ever say Paisley needed to be hit?"
"No."
"Did you ever say she needed the slap?"
"No."
"Did you tell Kallie to tell investigators it was an accident?"
"I was trying to calm her down."
"Did you intentionally strike Paisley's face?"
"No."
There it was.
Clear.
Under oath.
The same lie the recording was waiting to destroy.
During recess, Kallie went into the hallway.
Jennifer approached.
"You okay?"
"Ask me in six hours."
Jennifer gave a tiny smile.
Across the hall, Diane stood beside Richard.
Neither looked at Kallie.
Aunt Linda sat alone.
Paige talked quietly with Erin.
The old family arrangement was gone.
There was no center anymore.
Only individuals deciding where they stood.
Kallie realized something strange.
It felt healthier.
Painful.
But healthier.
No one person could order everyone to believe the same thing.
When court resumed, Elena stood.
"Your Honor, we request permission to introduce Exhibit 18."
The digital recorder was brought forward.
Authentication had been completed.
Owen's testimony established where the device had been.
Technical review established continuity of the audio.
The judge admitted it.
Seth leaned toward his attorney.
Diane whispered something to Richard.
Kallie felt her pulse in her hands.
Elena said, "The recording begins approximately six minutes before the incident and continues for nearly two hours."
The first clip played.
Paisley's voice.
"Pretty."
Seth:
"Don't touch that."
Kallie:
"Seth, she's fine."
The slap.
Paisley's scream.
Diane closed her eyes.
Richard's face went rigid.
Seth stared at the table.
Elena stopped playback.
She did not need to dramatize it.
The sound did everything.
Then the later clip began.
Seth:
"She needed it. Kallie lets that kid do whatever she wants."
Diane:
"You hit her too hard. Her cheek was bright red."
Seth:
"So what? She'll survive."
The courtroom seemed to contract.
Elena continued.
Richard:
"We need everyone on the same page before Kallie starts calling people."
Diane:
"What if she goes to the police?"
Richard:
"Then nobody saw anything."
Someone behind Kallie whispered, "Oh my God."
The judge looked up sharply.
Silence returned.
Then the coffee-table line.
"If anybody asks, Paisley fell against the coffee table. We all agree on that."
Kallie did not look at her mother.
She watched the judge.
His expression had changed completely.
No longer uncertain.
No longer sorting conflicting family memories.
He was listening to coordination.
Then the final section.
Richard:
"What about the people in the living room?"
Another relative:
"Jennifer saw it."
Richard:
"Jennifer needs to understand that family loyalty matters."
Seth:
"If Erin finds out, she'll use this in court."
Diane:
"Then make sure Hallie doesn't tell her."
The recording stopped.
For a moment, no one moved.
Then the judge leaned back.
"Counsel, I think we need a recess."
Seth's attorney stood immediately.
"Yes, Your Honor."
Kallie looked across the aisle.
Seth finally looked at her.
Not angry.
Not smug.
Afraid.
May you like
For years, Seth had survived by forcing other people to doubt their own experience.
Now he had been defeated by his own voice.
