Chapter 3 - The First Courtroom Lie

The emergency protection hearing began at ten the next morning.

Evelyn sat beside Claire in a private room adjoining the courtroom. She wore a blue dress and a high scarf. A victim advocate remained near the door, speaking softly whenever Evelyn’s hands began to shake.

Daniel sat across the courtroom with Simon Vale.

Neither man had been arrested.

Police had detained Simon after the fire, but the vehicle was registered to Evelyn, and Simon claimed he had been attempting to move it away from the house after smelling fuel. The remains of the red ledger were too damaged to identify.

Daniel told officers that Claire had returned unexpectedly, confused their mother, and barricaded her inside the bathroom.

His confidence did not surprise Claire.

What surprised her was the paperwork.

Daniel produced a medical evaluation signed by Dr. Adrian Lowe stating that Evelyn suffered from progressive cognitive decline and could be influenced by family members.

He also produced a durable power of attorney signed six months earlier.

The document gave Daniel control over Evelyn’s finances, medical decisions, and property.

Claire examined the signature.

It looked genuine.

Judge Mercer entered the courtroom.

Her expression revealed nothing.

Claire had known Helena Mercer since childhood. She had attended Christmas dinners at Whitmore House, brought books for Claire’s birthdays, and stood beside Evelyn at Arthur’s funeral.

Now she addressed everyone with formal distance.

“This is an emergency hearing,” she said. “The court is not determining ownership of property or the validity of estate documents today. The only question is whether immediate protection is necessary.”

Simon rose.

“Your Honor, the allegations are the result of a family dispute being transformed into a legal weapon.”

Claire remained seated beside Evelyn’s attorney, Nina Brooks.

Nina had arrived from Boston before dawn after receiving Claire’s message. She was sharp, direct, and unimpressed by the Whitmore family name.

Simon continued.

“Mrs. Whitmore is vulnerable. Her daughter appeared without notice, removed her from her home, and contacted the court before speaking to her physician.”

Nina stood.

“Mrs. Whitmore was found locked inside her own bathroom because she feared her son.”

“She was not locked inside,” Simon replied. “She locked the door herself.”

“Because Mr. Whitmore was outside attempting to enter.”

“Concerned for her safety.”

Nina played the recording.

Daniel’s voice filled the courtroom.

No one was coming to save her.

Simon’s expression did not change.

He waited until the audio ended.

“An incomplete conversation stripped of context.”

“What context makes that sentence appropriate?” Nina asked.

Daniel leaned toward Simon, but the attorney raised one finger, silencing him.

Judge Mercer looked at Evelyn.

“Mrs. Whitmore, are you able to answer questions?”

Evelyn nodded.

“Did your son cause the marks observed by officers?”

Evelyn looked toward Daniel.

He did not glare at her.

He smiled.

It was the small, encouraging smile of a devoted son.

Evelyn began to tremble.

Claire wanted to speak, but Nina placed a hand over hers.

Judge Mercer waited.

Evelyn finally answered.

“Yes.”

Daniel’s smile vanished.

“Did he prevent you from contacting people?”

“Yes.”

“Did he pressure you to sign documents?”

“Yes.”

Simon rose.

“Your Honor, we object to this line of questioning without medical testimony.”

“This is not a trial, Mr. Vale.”

“Then the court should be especially cautious.”

Judge Mercer turned toward him.

“I am being cautious.”

She issued a temporary order prohibiting Daniel from contacting Evelyn or entering Whitmore House. She also ordered the immediate suspension of Daniel’s authority under the power of attorney until a full competency evaluation could be completed.

Claire felt Evelyn exhale beside her.

The first victory was small, but it was real.

Then Simon placed another document on the table.

“There is one additional matter.”

Nina frowned.

“What is that?”

“A deed.”

The clerk handed it to Judge Mercer.

Simon spoke clearly.

“Whitmore House no longer belongs to Mrs. Evelyn Whitmore.”

Claire looked at Daniel.

He stared straight ahead.

“The property was legally transferred three months ago,” Simon continued. “My client is the sole owner.”

Evelyn whispered, “No.”

Simon opened a second folder.

“The company’s controlling shares were also transferred. As were the liquid assets held by the Arthur Whitmore Family Trust.”

Judge Mercer read the documents.

“Who prepared these?”

“My firm.”

“Who notarized them?”

“Elise Ward, a licensed notary and senior paralegal.”

“Where is Ms. Ward?”

Simon hesitated.

“She resigned last week.”

“Can she be contacted?”

“We have been unable to reach her.”

Claire remembered her mother’s words in the bathroom.

A woman from Simon’s office. Her name was Elise.

Nina requested an immediate freeze on the assets.

Simon objected.

Judge Mercer granted a limited seventy-two-hour freeze, explaining that broader restrictions required evidence of fraud.

The hearing ended.

As deputies escorted Evelyn through a private exit, Daniel called Claire’s name.

The protection order prevented him from approaching, but he stood far enough away to speak.

“You think you saved her?”

Claire stopped.

Nina warned her not to respond.

Daniel continued.

“You took her out of the only home she knows. You froze the company’s operating accounts. By Monday, hundreds of employees could miss payroll.”

“That money doesn’t belong to you,” Claire said.

“It doesn’t belong to her anymore either.”

Claire turned away.

Daniel’s next sentence stopped her.

“Ask Mom what happened the night Dad died.”

Evelyn stumbled.

Claire caught her.

Daniel watched them from across the hallway.

“He didn’t die from a heart attack,” he said.

Simon grabbed his arm.

“That is enough.”

But Daniel was smiling again.

“Tell her, Mom.”

Evelyn pressed both hands over her ears.

Claire guided her toward the exit.

Outside, Nina opened the car door.

Before Evelyn got inside, she looked at Claire with tears in her eyes.

“Daniel is lying about many things.”

Claire waited.

“But not about that.”
